MySpace and independent labels: a messy divorce?

CompanytownIf MySpace Music represents a hopeful new marriage between major record companies and Web 2.0, consider independent labels the jilted first wives.

Artists on indie labels flocked to MySpace early on because it offered an easy and free alternative to slick personal websites built by major label Internet whizzes. Their participation made MySpace a destination for music lovers, who could listen to songs and check tour dates for artists even if they didn’t have a MySpace profile.

The new MySpace Music offers a far vaster collection of songs for streaming and slapping on personalized playlists. The site, controlled by News Corp., is banking on that collection to draw more users and plays. In exchange for ponying up their stars’ oeuvres, major record labels received ad-revenue sharing deals and equity stakes amounting to 40% of the MySpace venture, as The Times reported.

But indies — whose artists are still attracting traffic to MySpace with their profiles and selection of streaming and embeddable songs — received no equity. And, indies say, major labels will reap the benefits of MySpace’s growth, even if it’s driven in part by independents.

“Our lovers were cheating on us,” says Tom Silverman, founder and chief executive of Tommy Boy Records. “Now we need to hire a great divorce lawyer.”

In other words, negotiations to get indies their share are continuing.

Jstt1cncspoon Some independent distributors such as Orchard already have deals to share ad revenue with MySpace Music. Merlin, which negotiates on behalf of thousands of independent labels and which has a combined market share that rivals major label EMI, currently has no deal but is in talks. And although Merlin could not be reached for comment at blog time, Silverman, who is a board member with Merlin, described the talks as “a lot of tap-dancing around.”


Ioda, a San Francisco based digital distributor and content aggregator of independent music, is also in talks. The company’s founder and CEO, Kevin Arnold, did not go into specifics, but says that “the major recording companies may have set a precedent that is right for them because of the equity they have in the business. They are owners of the company.”

When asked whether an ad-revenue sharing deal such as Orchard’s made sense for his label, Koch Records, Bob Frank, also a Merlin board member, said that “for the larger independents who have a real presence on the charts, it makes no business sense.” Koch Records is the largest independent label and has the No. 1 independent album this week, DJ Khaled’s “We Global.”

“Right now, having equity in MySpace may not mean much. But it may mean a lot two or three years down the road,” Frank said.

But Silverman warns that MySpace’s power may wane because it jilted indies, and because so many other social networking sites with streaming music are up and running.

“MySpace has been floundering lately already, and people have been moving toward Facebook and so on. This is going to accelerate that exodus,” he said. “We can make a decision where we promote an artist, and we don’t have to do it with MySpace. We’ve had a great relationship for a long time, but times change, and new technology comes along all the time.”

Travis Barker And DJ AM In Critical Condition Following Plane Crash [Breaking]

Tragedy struck in South Carolina last night, as drummer Travis Barker and DJ AM, aka Adam Goldstein, were critically injured in a Learjet crash that took the lives of four others. From the LAT report:

Federal Aviation Administration spokeswoman Kathleen Bergen said the plane carrying six people was departing shortly before midnight Friday when air traffic controllers reporting seeing sparks. The plane headed for Van Nuys, Calif., went off a runway, through a fence and crashed on a nearby road, officials said.


South Carolina officials say four California residents died in the crash.

The Lexington County coroner said today that pilot Sarah Lemmon of Anaheim Hills and co-pilot James Bland of Carlsbad died. Also killed were passengers Chris Baker, 29, of Studio City, and Charles Still, 25, of Los Angeles.

They were headed back to L.A. after performing at a free concert in Charlotte. TMZ is reporting they saved their own lives by jumping out of the wreckage; both are expected to survive, but have sustained serious burns. This is really awful. Two weeks ago, we were standing a few feet away from them at the VMAs rehearsal and remarking upon what a surprisingly tight show they put on, backing a wide array of vocalists. Developing…

Reader Review: “The Story of Edgar Sawtelle”

i am an avid reader. i have a eminent twenty favorite book list which i revise occasionally. as i was reading “the dispatch of edgar sawtelle,” i fixed this order would supersede whatever book was in, oh, maybe 5th arise.what a epic. while i am a lady-love of an advanced ripen, and hold lived a rather worldly and urban sort of individual, i have a dog. the writing, the descriptions, the complex and convoluted plot, the characters, were so superbly rendered, i often felt a true comeback to a twist or turn, the walking of the hedge with gar, or countless mornings with the dogs, the touches of the withers, the good-looking be thunderstruck of muteness and communication, the scariness of that impala. ai yi yi, i could not bring to a stop reading. when i did stop, to eat or take a load down, i was jittery about getting back to the book. in fact, for 4 or 5 days, reading was what i elected to do. i asked myself, how can someone send a letter take a shine to this, to envelope me into this story? to rope me in? about half way into the romance, i realized that i was in the anecdote. i cannot recall this still happening to me before in literature. i was edgar. i was secret him, seeing the world through his eyes, trying to interpret the last semi-words of father, finding unexplainable items in the grass, uncomfortable with claude, one with the dogs, especially almondine. oh, wow, almondine, and i became edgar and dog, savior and saved, rimester and squealer, motley and seeking.well, what i’m trying to say is that i moral got into the story and when edgar’s heart beat, mine did. when edgar stroked almondine, i did. i watched when edgar watched. i ran the dogs, i searched the mow, i ran away, i found henry, i bathed tinder’s paw. i was in the story.the me person fa?ade the story was amazed at this. i was swept along, knowing in my heart that some affectionate of justice would be done, some kind of truth would be revealed; and especially, the dogs would prevail. trudy was the thread. the porch light. for me, that was the final fulcrum upon which the truth would be revealed. i am not allowed to tell you the story, but at the end, i could not believe after all the beauty, the perfect details of land and love and family and treachery that it would all just poof, burn.i cannot recall a book more extraordinary that took a wrong wrong favour. oh, yes, it was probably the scheme lifetime is, and so now i forced to mourn, but, in fact, in this book, with edgar, i wanted a hardly any justice, a little really.i am shocked that this book has fake me so much. i can’t believe that after this lofty, etherial, gorgeous world has been created, that in the outcome, it is after all, well-grounded ether, scarcely meaningless. i am devastated. can you take it as given a person writing such a statement about a book?

(CNN) — This summer I found myself wishing someone would give voters useful and unbiased information about which candidate has the best plans for the economy.

Then I realized that I am someone, which is both inconvenient and expensive. So for once I asked not what my country could do for me.

At considerable personal expense, I commissioned a survey of over 500 economists, drawn from a subset of the members of the American Economic Association, a nonpolitical group, some of whose members had agreed in advance to be surveyed on economic questions.

The results do not represent the economic association’s position. The survey was managed by The OSR Group, a respected national public opinion and marketing research company.

I should pause here and confess my personal biases, since the messenger is part of the story. On social issues, I lean Libertarian, minus the crazy stuff.

Moneywise, I can’t support a candidate who promises to tax the bejeezus out of my bracket, give the windfall to a bunch of clowns with a 14 percent approval rating (Congress), and hope they spend it wisely.

Unfortunately, the alternative to the guy who promises to pillage my wallet is a lukewarm cadaver. I’m in trouble either way.

I just hope whoever gets elected notices that the economists in my survey don’t think that raising my taxes is a priority.

Nationally, most economists are male, and I’m told that most are registered as either Democrats or independents. Our sample reflects that imbalance:

48 percent — Democrats

17 percent — Republicans

27 percent — Independents

3 percent — Libertarian

Eighty-six percent of our economists are male, and 65 percent work in the field of academia or education. The rest are spread across various industries or not working.

We asked the economists which candidate for president would be best for the economy in the long run. Not surprisingly, 88 percent of Democratic economists think Democratic Sen. Barack Obama would be best, while 80 percent of Republican economists pick Republican Sen. John McCain.

Don’t Miss

Independent economists, who in our sample are largely from the academic world, lean toward Obama by 46 percent compared to 39 percent for McCain.

Overall, 59 percent of our economists say Obama would be best for the economy long term, with 31 percent picking McCain, and 8 percent saying there would be no difference.

We can’t know the degree of bias in our survey group. But we have some clues. On the issue of international trade, only 42 percent of our Democratic economists support Obama’s plans, with 34 percent favoring McCain. Independents favored McCain on this question by 63 percent to 16 percent, while favoring Obama overall.

Another indicator of objectivity is that the income levels of the economists have little impact on their opinions. The economists with lower incomes are no more likely to favor taxing the rich than the rich economists favor taxing themselves.

Likewise, economists in the academic world were largely on the same page as the nonacademic types in predicting which candidate would be best for the long term.
